Background: This article presents a scientific and legal analysis of the provisions of the current legislation of Ukraine and international legal acts in the field of protection of private property rights during the Russian-Ukrainian war. Based on historical and legal analysis of scientific heritage and modern scientific theories in the field of protection of private property rights and the right of possession by all subjects of public life, the authors of this article provide generalisations and recommendations for improving the effectiveness of international protection mechanisms in this area.
Methods: The authors resort to numerous research methods, such as the method of philosophical dialectics and hermeneutics, historical, comparative, structural, and functional methods, analysis and synthesis, and induction.
Results and Conclusions: The article examines international and Ukrainian regulatory legal acts that substantiate the mechanisms of acquisition, possession, and disposal of property owned by a person on the right of private property. Particular attention is paid to the latest problems associated with bringing to the established international responsibility war criminals involved in causing property damage and moral damage to the civilian population in connection with the destruction of private property. The authors suggest improving the mechanisms for the protection of the rights of private property that has been destroyed or damaged as a result of war crimes committed by Russian invaders on the territory of Ukraine.

АНОТАЦІЯ
Передумови. У статті представлено науково-правовий аналіз положень
чинного законодавства України та міжнародних правових актів у сфері
захисту права приватної власності під час російсько-української війни. На
основі історико-правового аналізу наукової спадщини та сучасних наукових
теорій у сфері захисту права приватної власності та права володіння всіма
суб’єктами суспільного життя автори статті надають узагальнення та
рекомендації щодо підвищення ефективності міжнародного захисту та
механізмів у цій сфері.
Методи. Автори вдаються до багатьох методів дослідження: метод
філософської діалектики та герменевтики, історичний, порівняльний,
структурно-функціональний методи, аналіз і синтез, індукція.
Результати та висновки. Досліджено міжнародні та українські нормативно-
правові акти, які обґрунтовують механізми набуття, володіння та
розпорядження майном, що належить особі на праві приватної власності.
Особливу увагу приділено останнім проблемам, пов’язаним із притягненням
до встановленої міжнародної відповідальності військових злочинців,
причетних до заподіяння майнової та моральної шкоди цивільному
населенню у зв’язку зі знищенням приватної власності. Автори пропонують
удосконалити механізми захисту прав приватної власності, яка була знищена
чи пошкоджена внаслідок воєнних злочинів, учинених російськими
загарбниками на території України. Проведений історико-правовий та логіко-
правовий аналіз теоретичної складової та матеріального забезпечення
процесів захисту власності в умовах російсько-української війни показав, що
міжнародні правові інструменти захисту права є практично неефективними, а
заходи, запроваджені окремі держави, обмежені своїм юрисдикційним
впливом. Автори статті посилаються на повну відмову Росії виконувати всі
рішення ЄСПЛ. Необхідно розуміти, що повернення коштів у якості
компенсації збитків, завданих воєнними діями Росії на території України,
неможливе.
