Abstract
Background: Vietnam regulates environmental information, damage assessment, evidence production, urgent protection, judicial expertise, and costs. Yet these rules are fragmented across environmental administration and civil procedure. Article 133(2) of the Law on Environmental Protection shifts the burden of proving the causal link to the violator or polluter in court. However, it does not specify how evidence is preserved, when the burden attaches, how administrative records become contestable civil evidence, or how individual loss is valued. The central problem is procedural connection, not a wholesale absence of evidentiary law.
Method: This Reform Forum Note uses doctrinal reconstruction and bounded functional comparison. Chà Và, Sonadezi-Bà Chèo and Vedan-Thị Vải are treated as separate historical stress tests, with adjudicated facts separated from details reported only in secondary sources. The stated legal propositions are based on primary legislation and published judgements. European Union (EU) environmental-information law, the Environmental Liability Directive, the Court of Justice's ERG judgement, and German environmental-liability law identify analogous procedural functions. The legal position is stated as of 8 September 2026.
Results and Conclusions: The Note defines remedial legal capacity as six linked functions: preservation and access, causal attribution, contestable expertise, multi-source allocation, individual valuation, and organisation of common issues. Its original contribution is to organise current Vietnamese law and lessons from the 2025 United Nations Development Programme-Ministry of Justice study into a staged protocol: preserve and screen; obtain targeted evidence and a responsive causal account; test expertise; determine common causation and source allocation; then value individual loss and supervise settlement. Reform is separated by legal vehicle. Existing powers can be coordinated now; public technical support and systematic administrative-civil transfer need an authorised regulatory and budgetary basis; broader retention duties, formal consequences for unjustified non-production and qualified representative proceedings require legislation. The objective is a contestable evidentiary process, not a lower standard of proof or preferential treatment of claimants.
