Анотація. Більшість правових систем мають давню традицію процесуального спрощення для дрібних спорів. Очевидно, що критерії, за якими справу можна кваліфікувати як "дрібну", відрізняються у різних правових системах. Найважливіший з них – це ціна позову, що відображає економічну ситуацію в певній країні. У будь-якому випадку, і незалежно від максимальної суми, яку можна стягнути, дрібні спори – це справи, які є найбільш важливими для пересічних громадян. Якби людям необхідно було звертатися до повноцінного судового розгляду, багато хто, ймовірно, відмовився б від своїх позовів, не маючи змоги нести відповідні витрати та з огляду на тривалість традиційної судової процедури. Саме тому правові системи повинні передбачати недорогі та прискорені процедури для дрібних спорів, якщо вони дійсно хочуть виконати обіцянку забезпечити доступ до правосуддя для всіх. У статті аналізуються різні рішення проблем розгляду й вирішення дрібних спорів, що діють у Франції та Іспанії. Автор зазначає, що важливе значення у цьому аспекті мають використання легкодоступних форм, доступність ІТ-платформ, спеціально розроблених для стягнення дрібних боргів. Італійська правова система не пропонує спрощених процедур для дрібних спорів. Стан справ в Італії щодо процесуального спрощення та дрібних спорів розглядається через призму юрисдикції італійських мирових суддів. Разом із тим, офіси мирових суддів не можуть вважатися аналогом судів для дрібних спорів в Італії, з огляду на те, що незалежно від ціни позову, сама процедура залишається незмінною, без спрощених функцій для позовів, ціна яких обмежена. Автор доходить до висновку що, хоча у дрібних спорах ціна позову і може бути обмеженою, це не обов'язково означає, що такі справи стосуються лише простих і звичайних питань, і це необхідно враховувати при розробці простих, швидких і недорогих процедур, що здатні гарантувати фізичним особам відповідні рішення їх юридичних проблем.
